Welcome to FarmStand. These Terms of Service ("Terms") are a legal agreement between you and FarmStand ("we", "us") governing your use of the FarmStand mobile app and related services (the "Service"). By creating an account or using FarmStand, you agree to these Terms. If you do not agree, please do not use the Service.
FarmStand lets farmers and roadside stands ("sellers") list produce and lets "buyers" discover those listings nearby. FarmStand is a neutral venue. We are not a party to any sale, we do not take possession of any goods, and we do not verify, endorse, or guarantee any listing, seller, buyer, product, price, or communication.
FarmStand does not process, hold, or transfer money and charges no transaction fees. Sellers may display peer-to-peer payment handles (such as Venmo, Cash App, PayPal, or Zelle) for convenience only. Any payment is made directly between the buyer and the seller through those third-party services, and pickup, exchange, and payment happen entirely outside the Service. You transact at your own risk. We are not responsible for payments made or not made, for goods delivered or not delivered, for refunds, or for any dispute between users. Please use good judgment, meet safely, and confirm details before paying.
You retain ownership of the content you submit — including listings, photos, farm descriptions, and messages ("Your Content"). By submitting Your Content, you grant FarmStand a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute it for the purpose of operating and providing the Service (for example, showing your listing and location to other users). This license ends when you delete the content or your account, except for copies retained in routine backups or as required by law.
You represent that you own or have the rights to Your Content and that it does not violate these Terms or any law.

There is zero tolerance on FarmStand for objectionable content or abusive behaviour. Listings, photos, profile details and messages that break the rules in Section 5 are not permitted, and accounts that post them may be removed without notice.

We review every report and aim to act within 24 hours. Where a report is upheld we may remove the content, suspend the account, or remove the user from FarmStand permanently. Reports are reviewed confidentially, and we do not tell the person reported who reported them.
If you believe someone is in immediate danger, contact your local emergency services first — FarmStand is not an emergency service.
FarmStand does not inspect, test, or guarantee any produce or other item listed on the Service, and makes no warranty as to the quality, freshness, safety, origin, or fitness of any item. Sellers are solely responsible for the items they offer. Buyers should inspect all produce before purchase and use their own judgment about quality and food safety. Any concern about a product is between the buyer and the seller.
Sellers are solely responsible for complying with all laws and regulations that apply to their sales. This includes, without limitation, cottage food laws, local licensing and permitting, food handling and labeling rules, weights-and-measures requirements, zoning, and tax obligations. FarmStand does not provide legal advice and does not verify that any seller is compliant. If you are unsure of the rules in your area, consult your local authority before listing.
You may stop using FarmStand and delete your account at any time using the in-app Delete Account feature. We may suspend or terminate your access, remove content, or restrict features at our discretion if you violate these Terms or if we believe your use harms other users or the Service. Sections that by their nature should survive termination (including content license terms already granted, disclaimers, and limitations of liability) will continue to apply.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any listing, user, or transaction is legitimate.
To the fullest extent permitted by law, FarmStand and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or for any harm, illness, injury, loss, or dispute arising out of or relating to your use of the Service, any transaction between users, any produce or other item, or any third-party payment service. Because FarmStand does not process payments and takes no fee, to the maximum extent permitted by law our total liability to you for any claim relating to the Service will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless FarmStand and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, your transactions with other users, or your violation of these Terms or any law.
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in New Jersey, unless applicable law requires otherwise. Nothing in these Terms removes any right you have to bring a claim in your own local courts where the law of your home state or country guarantees it.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of FarmStand after an update means you accept the revised Terms.
